Terms of Service.

1. Agreement to Terms

By paying a deposit, paying an invoice, accepting a quotation, approving a proposal, providing written confirmation, or otherwise instructing SheWe Creations to commence work, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. SheWe Creations is a trading name of Shewe Solutions.

2. Our Services

SheWe Creations provides creative services including but not limited to:

• • Brand identity and corporate design
• • UX/UI and website design and development
• • Photography and visual storytelling
• • Social media and digital content
• • Creative strategy and direction

The scope, timeline, deliverables, and pricing for each project will be outlined in a proposal, quotation, or written agreement before work commences.

3. Project Engagements

All project engagements are subject to the following conditions:

• • Payment of a deposit, invoice, acceptance of a quotation, approval of a proposal, or written instruction to commence work constitutes acceptance of these Terms of Service.
• • Work will commence once the required deposit has been received unless otherwise agreed in writing.
• • Deposits are required upfront as outlined in the applicable proposal or quotation.
• • Timelines are dependent on timely client feedback, approvals, content delivery, and payment schedules.
• • Clients are responsible for providing all required content, assets, feedback, approvals, and materials necessary for project completion.
• • Delays in client communication, approvals, or content delivery may result in revised project timelines.
• • Any services, revisions, or requests outside the agreed project scope may be quoted and billed separately.
• • SheWe Creations reserves the right to decline any project at its discretion.

4. Payment Terms

• • Payment terms are outlined in each individual proposal or quotation.
• • Late payments may result in project delays, suspension of services, or withholding of deliverables until payment has been received.
• • Deposits are non-refundable once work has commenced.
• • If a project is cancelled after work has commenced, the client remains responsible for payment of all work completed up to the cancellation date.
• • Final deliverables, source files, websites, applications, and other project assets will only be released upon receipt of full payment.

5. Intellectual Property

Upon receipt of full payment:

• • Ownership of the final agreed deliverables transfers to the client.
• • All preliminary concepts, drafts, unused designs, working files, and development assets remain the property of SheWe Creations unless otherwise agreed in writing.
• • SheWe Creations retains the right to display completed work in its portfolio, case studies, social media, and marketing materials unless otherwise agreed in writing.
• • Third-party assets, including fonts, stock imagery, plugins, software, and licensed resources, remain subject to their respective licensing terms.

6. Revisions & Scope Changes

Projects include the number of revision rounds specified in the applicable proposal or quotation. Revisions apply to refinements within the approved creative direction. Significant changes in direction, additional concepts, additional revision rounds, or work outside the agreed scope may incur additional fees. Any material changes to project scope, deliverables, or timelines must be agreed upon in writing.

7. Website & Digital Services

SheWe Creations is not responsible for:

• • Hosting failures or service interruptions
• • Domain registrar issues
• • Third-party software, plugin, or platform failures
• • Search engine ranking fluctuations
• • Security breaches caused by third-party providers or software
• • Future updates to third-party platforms that may impact functionality

Unless expressly included in the project scope, ongoing maintenance, monitoring, security updates, content updates, and technical support are not included and must be arranged separately.

8. Cancellations & Termination

Either party may terminate a project by providing written notice. Deposits remain non-refundable. The client is responsible for payment of all work completed up to the termination date. Outstanding balances must be settled before any final files, assets, or deliverables are released. Projects that remain inactive due to client non-responsiveness for more than 30 days may be paused, rescheduled, or terminated at the discretion of SheWe Creations.

9. Limitation of Liability

SheWe Creations shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of its services, deliverables, or website. The total liability of SheWe Creations for any claim relating to a project shall not exceed the total amount paid by the client for the specific project.

10. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or the services provided by SheWe Creations shall be subject to the jurisdiction of the South African courts.
